Thomas Skidmore et le droit de transmettre et d’hériter
Resumo
Né en 1790, mort du choléra en 1832, Thomas Skidmore est l’un des principaux représentants de l’agrarianisme aux Etats Unis dans la première moitié du XIXè siècle. Inspiré par les principes développés par Thomas Paine dans Agrarian Justice, il publie en 1829 un livre intitulé The rights of Man to property dans lequel il développe les conséquences de l’idée que, le monde étant la propriété commune de l’ensemble des hommes, chacun possède un droit imprescriptible à une part égale des ressources naturelles. Parmi ces conséquences figure la thèse selon laquelle ce principe rend impossible tout droit de tester, dans la mesure où un tel droit rendrait impossible que chaque nouvel arrivant ait accès à la juste part de propriété à laquelle il a droit. Skidmore élabore ainsi une théorie précise des raisons pour lesquelles le testateur, une fois disparu, ne peut plus posséder aucun droit sur les biens dont il était le propriétaire durant sa vie.
