New compensatory avenues in unfair disciplinary dismissal:
ILO Convention 158 and Article 24 of the ESC
Abstract
The disciplinary system for sanctioning workers' infractions in our country offers multiple options to employers, with the primary objective of reeducating workers, in line with constitutional principles. However, the misuse of disciplinary dismissal has been a constant issue since the enactment of the Workers' Statute. The Royal Decree-Law 3/12 of February 10 addressed this business demand by significantly reducing the consequences of unjustified disciplinary dismissal. There is a European trend, based on recent decisions by the European Committee of Social Rights of the Council of Europe, which argues that limiting compensation awarded to workers in cases of unjustified dismissal violates Article 24(b) of the revised European Social Charter.
