Abstract

This article analyses the impact of the so-called “Alfonsine jurisdiction”, one form of low criminal jurisdiction granted by the Crown in 1329 to the holders of small territorial domains, over the Moslem and Christian peasantry of the kingdom of Valencia. Through an historiographical perspective that begins in the 19th century and extends to present days, the interpretations of the liberal erudition and those of the social and economic history are studied, to propose a new reading based on the relevancy of the colonial character of the Valencian society in the Middle Ages, where the Moslem peasants were submitted to jurisdictional conditions harder than the descendants of the Christian settlers.
