Assisted reproduction technology in Mexico: A reality ignored in its legislation

Abstract

This paper presents the legal situation in Mexico, both at the federal and state levels, regarding assisted reproduction technology. First, the situation at the federal level is presented regarding the legislation and jurisprudence that govern this issue, as well as the competent authority to regulate the establishments where these procedures are performed. Subsequently, the legislation in the states where there is reference to assisted reproduction techniques is analyzed and the information provided by the health authority of the 32 states is shown regarding the type and number of assisted reproduction procedures performed in the entity, the number of public and private clinics that operate in the state, as well as the number of births registered as a result of the use of assisted reproduction technology.
