The impact on the registry function of Regulation (EU) 2016/1103 on matrimonial property regimes
Abstract
Council Regulation (EU) 2016/1103 June 24th, 2016 establishes enhanced cooperation in the field of jurisdiction, applicable law, recognition and enforcement of rulings on matrimonial property regimes came into force since January 29th, 2016. Despite excluding real rights and registration in the Property Registry from its scope of application, it has an important impact on the registry function related to marital economic regimes, as it is intended to demonstrate in this article.
