Consideraciones sobre el sistema de elección de los vocales del Consejo General del Poder Judicial

Abstract

In this article we examine the appointment system of the members of the General Council of the Judiciary in the light of the Organic Law 2/2001, 28th June. This Organic Law rules the composition of the General Council of the Judiciary, and modifies the Organic Law 6/1985, 1st July, ruling the Judiciary. Since the monopoly of the parliamentary groups is restricted when they present the candidates who are called to occupy the vacancies of the Council, it could be interpreted as it could serve to secure the renovation of this organism as and when required. However, it does not happen like that, as it can be shown by the intrinsic difficulties in the renovation of the composition of this organism proposed for the year 2006. To avoid this situation, we will consider some propositions to improve the current system.
