UTOPIA AND IMAGINARY WORLD IN LAW

Abstract

In this article it is argued that the most interesting thing about utopia is not its ignorance of reality but the fact that it imagines a world that is of use when comparing and criticising reality. This is followed by an analysis –together with examples of the legal and literary history of Spain– of three dimensions of utopia in regards to law: positive utopias from order, positive utopias against order and negative or empty utopias.
